WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND TERMS OF USE
Evo Training Collective LLC
Please read this Waiver of Liability, Assumption of Risk, and Terms of Use (“Agreement”) carefully and in its entirety before participating in any activities at Evo Training Collective. By signing this Agreement and/or checking the acceptance box during registration or checkout, you acknowledge that you have read, understand, and voluntarily agree to be bound by this Agreement.
This Agreement applies to all training, use of facilities, services, programs, and equipment provided by Evo Training Collective LLC (“the Gym”).
“Company,” “We,” “Our,” “Us,” or “the Gym” refers to Evo Training Collective LLC and its owners, Tovah Rendlich-Texidor and Tayna Rendlich-Texidor.
“Participation,” “Participating,” or “Use” means entering the facility, engaging in training, using equipment, receiving instruction, or otherwise engaging in any activity at or through the Gym.
“You,” “Client,” or “Member” refers to the individual participating in the Gym’s activities.
By signing this Agreement and/or electronically accepting it, you acknowledge that you voluntarily choose to participate in activities at Evo Training Collective and agree to comply with all Gym rules, policies, and instructions, whether written or verbal.
You understand that participation is entirely voluntary and that you may discontinue participation at any time.
You understand and acknowledge that participation in fitness training and use of a gym facility involves inherent risks, including but not limited to:
• Muscle strains, sprains, or tears
• Joint injuries
• Slips, falls, or collisions
• Equipment failure or misuse
• Overexertion
• Aggravation of pre-existing conditions
• Serious injury, permanent disability, or death
You acknowledge that some activities may take place without supervision, including during non-staffed hours.
You affirm that you are physically able to participate and that you have consulted with a physician if you have any medical conditions, injuries, or limitations. You voluntarily assume all risks, known and unknown, associated with your participation at the Gym.
To the fullest extent permitted by California law, you hereby release, waive, discharge, and covenant not to sue Evo Training Collective LLC, its owners, employees, contractors, coaches, agents, affiliates, and representatives from any and all claims, demands, causes of action, damages, or liabilities arising out of or related to your participation in the Gym.
This release includes, without limitation, claims arising from the ordinary negligence of Evo Training Collective LLC.
You agree to defend, indemnify, and hold harmless Evo Training Collective LLC from any claims, actions, damages, costs, or attorney’s fees arising from your participation, violation of Gym rules, or breach of this Agreement.
This release does not apply to claims arising from gross negligence or willful misconduct, to the extent such claims cannot be waived under California law.
Any dispute, claim, or controversy arising out of or relating to this Agreement or your participation in the Gym shall first be attempted to be resolved informally by contacting evotrainingcollective@gmail.com.
If the dispute cannot be resolved informally, you agree that it shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable rules.
You understand that by agreeing to arbitration, you are waiving your right to a jury trial or to bring claims in court.
Any arbitration shall take place within 25 miles of Sacramento, California, and judgment on the arbitration award may be entered in any court of competent jurisdiction.
To the fullest extent permitted by law, Evo Training Collective LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Gym.
You understand that the Gym does not guarantee results and is not responsible for injuries resulting from misuse of equipment, failure to follow instructions, or participation beyond your physical limits.
You acknowledge that a 24/7 gym membership is a privilege based on trust and may be revoked at the Gym’s sole discretion.
You agree to abide by all posted Gym rules, including 24/7 access rules, which may be updated from time to time.
Additional 24/7 rules include but are not limited to:
• Only one member may enter at a time during non-staffed hours
• Code sharing is strictly prohibited
• Only active members may access the facility
• Open gym hours are Monday–Friday 1:30pm–10pm; weekends all day
Any violation, including code sharing, may result in immediate suspension or termination of membership.
You understand that during non-staffed hours, there may be no supervision or assistance available.
You acknowledge that:
• Surveillance cameras record but are not continuously monitored
• The Gym has no duty to provide emergency assistance during non-staffed hours
• Injury, unconsciousness, or medical emergencies may occur without immediate aid
Emergency alarms and alert pendants are provided; however, you assume full responsibility for your safety while using the facility.
You grant Evo Training Collective LLC permission to use your name, image, photographs, videos, testimonials, and feedback for marketing and promotional purposes without compensation, unless you revoke consent in writing.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
This Agreement shall be governed by and construed in accordance with the laws of the State of California.
By signing below and/or accepting electronically, you acknowledge that you have read this Agreement, understand its terms, and voluntarily agree to be bound by it.
